Agreement
By accessing or using Sineward, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. “Sineward” includes the website, browser composer, bundled sound materials, documentation, and related services operated by Scalar Shift LLC (“Scalar Shift,” “we,” “us,” or “our”).
The service
Sineward is a browser-based tool for composing binaural tones, isochronic pulses, generated noise, field-recording layers, automation schedules, and audio exports. Project data and audio remain stored locally in your browser and rendering runs on your device. Accounts identify users and provide access to paid features; they do not currently provide cloud project backup, medical services, or guaranteed long-term project storage.
Eligibility
You must be at least 13 years old to use Sineward. If you are under the age of legal majority where you live, you may use it only with permission and supervision from a parent or legal guardian who agrees to these Terms. Do not use Sineward if applicable law prohibits you from doing so.
Accounts
You may use the core composer without an account. An account is required to purchase or use Sineward Pro and manage billing. You are responsible for accurate account information, maintaining the security of your sign-in methods, and activity under your account. Account authentication is provided by Clerk.
Pro subscriptions
Sineward Pro costs US$39 per year unless a different price or promotion is clearly shown at checkout. Applicable taxes may be added. Subscriptions renew automatically each year using the payment method on file until canceled. Stripe processes payments and provides receipts, invoices, payment-method management, and the customer billing portal.
You may cancel renewal at any time through the Account page and Stripe billing portal. Cancellation takes effect at the end of the paid term, and Pro access continues until then. Except where required by law or expressly stated at checkout, fees already charged are non-refundable. We may change future pricing with advance notice; a price change applies no earlier than the next renewal.
Permission to use Sineward
Subject to these Terms, Scalar Shift grants you a limited, revocable, non-exclusive, non-transferable permission to access and use Sineward for lawful personal or business purposes. This does not transfer ownership of Sineward, its software, design, branding, or documentation.
You may not copy, sell, sublicense, or commercially redistribute the Sineward service itself; remove proprietary notices; bypass security or usage controls; use automated means that unreasonably burden the service; or reverse engineer the service except where applicable law expressly permits it.
Your content and exports
You retain any rights you already hold in project instructions, names, uploaded audio, and original material you use with Sineward. You are responsible for ensuring that you have the rights and permissions required for every file you use and every export you distribute.
Scalar Shift does not claim ownership of your locally stored project or finished audio. Because Sineward can combine your material with generated sound and bundled public-domain or CC0 recordings, copyright status may vary by component and jurisdiction. Review the source credits in Sineward before relying on an export for commercial distribution.
You are responsible for backups. Browser storage can be cleared, corrupted, evicted, or made unavailable by browser or device changes.
Health and safety
Sineward is a sound instrument, not a medical device or healthcare service. It does not diagnose, treat, cure, prevent, or guarantee improvement of any condition. Statements about focus, relaxation, sleep, meditation, or perceived effects are descriptive use cases, not medical claims.
Listen at a comfortable volume and stop if you experience discomfort, dizziness, headache, anxiety, disorientation, or other unwanted effects. Do not use Sineward while driving, cycling, operating equipment, or doing anything requiring full attention. Seek advice from a qualified healthcare professional before use if you have concerns about sound, hearing, neurological conditions, or other health circumstances.
Acceptable use
Do not use Sineward to violate law or another person’s rights; distribute malware or harmful content; interfere with the service or other systems; impersonate others; probe for vulnerabilities without written permission; or create, distribute, or promote content you do not have the right to use.
Third-party materials and links
Sineward includes or references third-party services and materials, including Clerk authentication, Stripe payments, public-domain and CC0 field recordings, browser technologies, open-source software, and links to external documentation. Their separate terms and policies continue to apply. External services are not controlled by Scalar Shift, and we are not responsible for their content or availability.
Availability and changes
We may update, suspend, limit, or discontinue any part of Sineward. We do not promise that the service will always be available, error-free, compatible with every browser, or that locally stored data will remain accessible. We may update these Terms by posting a revised version with a new effective date. Continued use after a change means you accept the revised Terms.
Disclaimers
To the fullest extent permitted by law, Sineward is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Scalar Shift disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant any particular listening, wellness, productivity, or health outcome.
Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Scalar Shift LLC and its owners, personnel, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from Sineward or these Terms.
To the fullest extent permitted by law, Scalar Shift’s aggregate liability for claims relating to Sineward will not exceed the greater of US$50 or the amount you paid Scalar Shift specifically for Sineward during the twelve months before the event giving rise to the claim. This limitation does not apply where it is prohibited by law.
General terms
These Terms and the Privacy Policy are the entire agreement about the current Sineward service. If one provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver. You may not assign these Terms without our consent; Scalar Shift may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets.
No governing-law, venue, arbitration, or class-action-waiver provision has been included in this draft pending confirmation of Scalar Shift LLC’s jurisdiction and legal review. Before launch, those choices should be made deliberately rather than inferred from a website visitor’s location.
